Brookside Oak is a project by Oak Developers.

These Terms and Conditions govern the use of the Brookside Oak website and the process for reserving and purchasing property within the development. By accessing this site or making a reservation, you agree to be bound by these terms.

1. General Information

  • Developer: Oak Developers (Hereinafter referred to as “The Developer”).

  • Project: Brookside Oak Residency, located along Muguga Green, Westlands, Nairobi.

  • These terms are governed by the laws of the Republic of Kenya.

2. Website Use and Intellectual Property

  • All content on this website, including text, graphics, logos, images, and software, is the property of Oak Developers and is protected by Kenyan and international copyright laws.

  • You may not reproduce, distribute, modify, or republish any content without prior written consent from the Developer.

  • Artistic impressions, renders, and CGIs are for illustration purposes only and may not represent the final finish.

3. Unit Pricing and Availability

  • Prices: All prices listed (e.g., “Classic 1 Br from KES 9M”) are indicative, subject to change without prior notice, and are valid as of the Effective Date.

  • Availability: Unit availability is dynamic. A unit shown on the website may be sold or reserved at any time.

  • Sizes: Floor areas (e.g., 65㎡) are approximate. Precise measurements may vary slightly upon final survey and completion.

4. Booking and Reservation (The KES 500k Offer)

By paying the booking fee of KES 500,000, you agree to the following:

  • Reservation Fee: The KES 500,000 is a booking fee to secure your preferred unit during the early-bird phase.

  • Refundability: This fee is refundable only if the Developer fails to deliver the unit as per the agreed terms, or if the formal Sale Agreement is not executed due to the Developer’s default. It is non-refundable if the Purchaser withdraws from the purchase after the reservation is confirmed.

  • Application: Upon execution of the formal Sale Agreement, this amount will be deducted from the total purchase price as part of the deposit.

5. Payment Plan

  • Estimated Period: February 2026 – June 2029.

  • Structure: The 40-month payment plan will be detailed in the formal Sale Agreement. Purchasers are expected to adhere to the installment schedule to avoid penalties or cancellation of the booking.

6. Sale Agreement

  • The formal Sale Agreement will be prepared by the Developer’s lawyers upon reservation.

  • It is the Purchaser’s responsibility to review the agreement (ideally with their own legal counsel) before signing.

  • The terms of the Sale Agreement supersede any marketing material or verbal representations made on this website.

7. Force Majeure

The Developer shall not be liable for any delay or failure in performance resulting from causes outside its reasonable control, including but not limited to acts of God, war, terrorism, government regulations, or labor disputes.

8. Limitation of Liability

To the fullest extent permitted by law, Oak Developers shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of this website or the purchase of a property.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Kenyan courts.
